Toll Violations in Florida: How to Handle a Toll Violation in Florida

Recently, I have been seeing many cases where someone comes to my office because they have received a letter from the DMV stating that their license will be suspended. A problem I’m starting to see a lot When a driver goes through a toll plaza without paying the proper toll, a digital image of the cars license plate is recorded. Under Florida law, the Authority may use this image to issue a uniform traffic citation.

Many people don’t realize they have a problem with their Sun Pass until they get a letter in the mail telling them their license will be suspended. To avoid suspension they go ahead and pay the tickets. They don’t realize that by paying the tickets they are pleading guilty to a traffic violation that carries three points, and that by racking up too many points their license will be suspended.

Don’t pay for those tickets! They are considered traffic violations. For each ticket you pay you will receive 3 points for your license. As a result, your driver’s license could be suspended.

The applicable Florida Statute covering toll violations is Chapter 316.1001:

Toll payment is required at toll facilities; sanctions.–

A person may not use any toll facility without paying the tolls, except as provided in s. 338,155. Failure to pay a prescribed toll is a non-criminal traffic violation, punishable as a moving violation under chapter 318.

Effective July 1, 2007, fines for toll violations will increase to $176.50 plus the unpaid toll fee.
